1. Acceptance of Terms

By accessing or using The Draught Shop website, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

We may modify these Terms at any time. Your continued use of the Services after any changes indicates your acceptance of the revised Terms.

2. Description of Services

The Draught Shop provides tools and resources for draught beer professionals, including but not limited to: draught system diagnostics, pressure and profitability calculators, educational content through the Draught Academy, business directory listings, and booking services for draught-related professionals.

Some features require creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Accounts

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement.

4. Business Listings and Bookings

The Services allow businesses to create listings and users to book services with listed businesses. Business Pro members may access additional dashboard features for managing bookings and their listing.

We do not guarantee the accuracy of business listings, the availability of services, or the quality of work performed by listed professionals. Users are encouraged to conduct their own due diligence before engaging services.

Payments for services or subscriptions are processed through our third-party payment processors. All fees are exclusive of applicable taxes unless stated otherwise.

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe upon the intellectual property rights of others
  • Transmit any harmful code, malware, or viruses
  • Interfere with or disrupt the integrity or performance of the Services
  • Harass, abuse, or harm another person
  • Upload false, misleading, or fraudulent content in business listings
  • Attempt to gain unauthorized access to any part of the Services

6. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof — are owned by The Draught Shop or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent.

7. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

Educational content and diagnostic tools are provided for informational purposes only and do not constitute professional advice. Always consult a qualified draught technician for critical system decisions.

8. Limitation of Liability

To the fullest extent permitted by law, The Draught Shop and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, even if advised of the possibility of such damages.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
